Not Guilty by Reason of Insanity

1. After reading the case study, what criteria must someone meet to be ruled legally insane?
2. Do you support the use of the insanity please? Why or why not?

    2. No, because if they commit a crime, they should go to jail no matter what. People who are affected by the crime want the person to go to jail. Not get off the hook.

    1). Must be diagnosed with a severe psychological disorder, at time of crime person did not understand the nature of the act or that it was wrong.

    2). I support it. if someone really is insane then they can't be judged the same way an sane person is because their mind is different from a normal persons. if they are insane then they need help, not prison.

    2) I support it because some people really are insane and cannot help what they are doing. But i do believe that it must be proven beyond reasonable doubt that they were insane when they committed the crime.

    2. Yes, because someone could be mentally insane and not realize what they are doing, but i think they should stay in psychiatric center.

  7. The accused must be diagnosed with a severe psychological disorder. When an accused person pleads insanity, prosecuting attorneys try to demonstrate that the accused was sane at the time of the crime. While the defense tries to prove that the accused was not sane. I do support the use of insanity plea, because the disorder may have control over the person and the person can not stop it from happening.

  8. 1) someone must be ruled legally insane in some states they may be accused with a severe psychological disorder. the burden of proof has been shifted from the prosecution to the defense. it is now up to the defense to prove the accused was insane. one is either sane or insane.
    2) i just support the insanity plea if something is actually wrong with the person mentally. if they are faking, then i don't agree.

    2.) Yes, because some people are insane and they shouldn't be punished for a crime they did while they were in a wrong state of mind. But, they should also consider whether or not they were in the right state of mind when they did the crime. If they were aware of what they were doing during the time of the crime, then they shouldn't go to a psychiatric institution. But, if they weren't in the right state of mind then they should be able to be ruled legally insane and go to a psychiatric institution.

  12. The person has to be accused of the psychological disorder and proof has to be sent from the persecution to the defense. I agree to a certain extent because sometime most psychologist can not determine whether or not if the person is real about the problems they have or fake. Mostly if the person has a disorder than yes i feel that they do not have control of the decisions they make (whether they are right or wrong).

  13. 1. The person that committed the crime has to be accused with a severe psychological disorder.

    2. I definitely do not agree with the insanity plea at all. The reason is because if a person has a psychological disorder bad enough to commit a crime or kill a person then they should be supervised 24/4 anyways. Therefore, if they are supervised then nothing would happen and we wouldnt have to have an insanity plea.

  14. The criteria that someone must meet to be consider legally insane is that they have to be diagnosed with a serve psychological disorder. I don't agree because people who kill someone should pay for what they do and not get away with it just because they have some sort of disorder and go to an institute
